1. In accordance with Section 21 of the Act the identity of the Independent Person is already publicly available. The Council does not hold details of his qualifications, however the link provides a description of his experience. He is also the Independent Person for a number of other District Council’s in Devon and the County Council 2. and 3. The Council does hold some information that falls under these points of the request, however upon careful consideration the Council has determined that it is the applicant’s own personal data (i e the emails held relate to the applicant as an individual and not third parties) and therefore they do not fall under the remit of the Freedom of Information Act. The Revenues department confirm that they do not have a report within its system that can extract all of the data requested into a spreadsheet. Data would need to be compiled from a number of reports and also by going into each individual account and then be entered into a spreadsheet
Furthermore, the system does not have an indicator to separately identify ‘companies, associations and any other form of corporation’ and so this can only be done by manually looking at the name of the ratepayer for each account in order to identify those accounts that fall within the remit of your request. A conservative estimate of at least five minutes would be required to check each account
It has been estimated by the Revenues department that it would take approximately 3,958.3 hours to provide the requested information. The procedure would cause serious disruption to the day to day working of the Revenues department and therefore we are unable to process your request any further. As set out in the previous paragraph, the Council has the right to refuse to provide the information in accordance with Section 12 of the Act. 1.For Council Tax purposes there are currently 5,805 domestic dwellings within the parish of Ilfracombe 2.There are currently 5,805 domestic dwellings included in the Council Tax List for the parish of Ilfracombe 3.265 are classed as second homes. No discount is given, the full Council Tax charge is payable 80 are classed as empty and unfurnished for more than three months. No discount is given, the full Council Tax charge is payable 46 are classed as empty and unfurnished for less than three months and receive 100% discount. The discount is only for the period the property remains empty and unfurnished and is for a maximum of three months 4. Most customers are on annual payments and therefore pay for their trade agreement in advance. The only customers that pay in arrears are predominately larger businesses or campsites where they have multiple bins on site Debt reports are reviewed each week and are referred to the Council’s Legal department as appropriate. The Trade Waste team has three step process in chasing debt which results in a termination of agreement and a referral to colleagues in Environmental Health for failure to hold a Trade Waste agreement who then conduct site visits. This process also includes removal of containers and the ceasing collection 7.
