What do you mean by fly tipping?

Fly tipping is the illegal dumping of rubbish in sites that are not prescribed for waste disposal?

Do you deal with fly tipping in any location?

No. North Devon Council is concerned with the prevention of fly tipping on council land and certain other areas of public access. The council is not responsible for the removal of fly tipping on private land. This is usually the landowner’s responsibility.

Fly tipping on private land may be the result of someone operating an illegal dump, especially if it is ongoing. In this situation, any complaints of this type will be referred onto the Environment Agency (01392 444000) or Customer Services (01271 388870) for further investigation.

Where a private landowner has been affected by fly tipping due to the actions of a third party and isn't making arrangements for the fly tipping to be removed, the council may investigate and where necessary take formal action to ensure that the tipping is removed. For example, the fly tipping may be causing a nuisance as determined by the investigating officer, such as attracting rats or giving rise to an unpleasant smell.

Examples of fly tipping on public land that the council will deal with are:

  • dumping of refuse in road lay-bys
  • dumping of household items in a council pay and display car park
  • dumping of refuse in the street before the normal collection day

We view fly tipping very seriously, especially as its removal is at the local taxpayers expense. Fly tipping reported to us will be investigated to determine its source, for example name and address on a discarded household bill or confirmation from a member of the public. If confirmed, the person responsible may be liable to further enforcement action, namely prosecution.

What should I do if a see fly tipping in my area?

Report it to us using our contact details. An officer will investigate the situation as soon as possible. If appropriate, you will be given feedback on progress and the final outcome.
