The Decision

All applications will either be determined within eight weeks or be presented to the relevant Area Committee within that same period. Those presented to committee may, in total, take more than eight weeks to determine depending on their complexity or where negotiations have been entered into.

Applicants may lodge an appeal if no decision is reached within the eight weeks. However, they are invited to extend the time period to enable the application to continue to be determined.

Some decisions are delegated to the Planning Manager to determine.

Meetings of the committees are open to the public and you can see the relevant papers at the Civic Centre 5 workings days before the meeting.

Applications are determined in one of three ways: -

1. the proposal may be approved with conditions.

2. the proposal may be approved without conditions.

3. the proposal may be refused, with the reasons of refusal clearly stated.

Sometimes an approval is subject to a legal agreement being entered into with the District Council or County Council as Highway Authority. This agreement is known as a "Section 106 Obligation".
