Questions to ask your conveyancer

Buying or selling a property is probably the biggest financial transaction you will make in your life. Therefore, it is important to get it right. Below we list the questions you should be asking your conveyancer about local land charge searches.

1. What sort of search will be in the Home Information Pack (HIP)?
An official local authority search undertaken by North Devon District Council or a personal search?

2. Does the search rely on indemnity insurance to cover missing information, or is it a full local authority search that requires no additional insurance?

3. If there is indemnity insurance, when does it expire? Is this acceptable to the buyer of the property? One example is searches prepared by one company, their insurance expires on the day of transfer of the property. Therefore you could move into the property and discover a problem that should have been identified on the search. You will have no claim against this company as the insurance has run out. Do not take that chance. The official North Devon District Council local authority search has insurance that lasts forever.

4. Will the mortgage lender accept the search and if so who will be held liable for missing or inaccurate information?

5. If you are a home buyer or solicitor acting on behalf of a buyer, you have the right to reject the search provided in a HIP

6. Will I receive a full copy of the search information once it has been undertaken?

7. Can you obtain additional information obtained free of charge regarding the search?

North Devon District Council will only respond to enquiries raised regarding its own official local land charges searches. We do not respond to enquiries regarding personal searches.

8. Is the person that provides the information in the local land charges search result fully trained?
