LAPC and LAPPC Charges

The Pollution Prevention and Control Act 1999 provide for the setting of fees and charges for Local Authority – Integrated Pollution Prevention and Control (LA-IPPC), and Local Air Pollution Prevention and Control (LAPPC) at levels that will recover costs to local authorities of implementing the system. The fees and charges are set nationally by DEFRA in consultation with affected industries and local authorities. The charges for 2008/09 are currently out to consultation, and it is likely that they will be implemented unchanged. The charges are as follows:

When paid quarterly, the total amount payable to the local authority will be increased by £35.00. There is no extra fee payable to the Environmental Agency where quarterly payments are made.


In the case of a discharge consent local authority permit, 56% of the annual charge that would be payable under the Environmental Agency Discharges to Controlled Waters Charges Scheme in relation to the financial year if the discharge or discharges authorised by the permit were permitted by a consent given or served by the Environmental Agency under Part III of the Water Resources Act 1991, is payable to the Environmental Agency.


Newspaper adverts may be required under EPR at the discretion of the council as part of the consultation process when considering an application. These will be placed by us and the charges will contain a provision for us to recover any costs from the operator

The Large Venue fees above do not apply where the premises in respect of which the application has been made:

(a) is a structure which is not a vehicle, vessel or moveable structure, and

(b) has been constructed or structurally altered for the purposes, or for purposes which include the purpose, of enabling -

(i) the premises to be used for the licensable activities the applicant proposes the licence should authorise,

(ii) the premises to be modified temporarily from time to time, if relevant, for the premises to be used for the licensable activities referred to in the application;

(iii) at least the number of persons the applicant proposes should during the times when the licence authorises licensable activities to take place on the premises, be allowed on the premises, to be allowed on the premise at such times, and

(iv) the premises to be used in a manner which is not inconsistent with the operation schedule accompanying the application.

Exemptions
Applications for Premises Licences/Club Premises Certificates, which relate to the provision of regulated entertainment only - NO FEE payable, where:

1. The application is by a proprietor of an educational institution in respect of premises that are or form part of an educational establishment:

(a) The establishment is a school or college;

(b) The provision of regulated entertainment on the premises is carried on by the establishment for and on behalf of the establishment; OR

2. The application is in respect of premises that are or form part of a church hall, chapel hall or similar building or a village hall, parish hall, or other similar building.

Additionally, NO annual fee is payable under the above exemption.

Criminal Records Bureau

The Criminal Records Bureau (CRB) has been set up by the Home Office to improve access to Criminal Record Checks for employment-related and voluntary appointment purposes. The Bureau is the Council’s sole source of such checks through its Disclosure Service.

The Environmental Health Unit will use the Disclosure process to ensure the suitability of applications for certain licences and registrations. Where such checks are required, an additional fee of £31.00* for a Standard Disclosure or £36.00* for an Enhanced Disclosure may apply. This fee will be passed directly to the CRB.

Once completed by the applicant, the request for Disclosure form is handed back to the Council, countersigned by an authorised signatory and then forwarded to the Bureau for appropriate action.

The applicant will receive the original disclosure information for their reference. The Council will receive a copy of the information to help determine the outcome of the relevant application.

All disclosures are handled according to a Code of Practice, a copy of which is available on request.
