Dangerous Buildings

In the interests of public safety, the Council may seek an order from the Magistrates Court requiring the Building owner to remove all or part of a building which is considered to be a danger to those in, or around the building. Where the Council surveyor considers the conditions of the building warrant emergency measures, the surveyor has the powers to authorise immediate remedial work. (Building Act 1984, Sections 77 and 78 refer).

How will we carry out the service?

Once the Council becomes aware of a dangerous state of a building, a surveyor will inspect the premises and report any action required. If any work is considered necessary, the Council will inform the owner of any necessary work required.

If the owner does not carry out the necessary works an order requiring the work to be done will be sought from the Magistrates Court. Failure to comply with the Court Order within the specified time will result in the Council arranging for the work to be done. Again, a surveyor will inspect the necessary works before and after completion and the owner notified of satisfactory completion.

How much does the service cost?

The Council may seek to recover the costs of obtaining an order from the Magistrates Court and also the costs of undertaking any remedial work in emergency situations or where the owner fails to comply with the court order.

Where can I find Building Control?

The offices of Building Control are located in the Civic Centre at Barnstaple. Offices are open between 8.30am and 5.00pm Monday to Friday.

Appointment with surveyors can be made during these hours, either at the office or on site at times which are mutually convenient.
