Terms and conditions for chargeable garden waste service

Responsibilities of the council

The council will:

  • Offer a paid for garden waste collection service within North Devon Council’s boundaries. The council will not collect from allotments, cemeteries or other non-residential properties
  • Accept garden waste on scheduled collection days that is presented in a registered green wheelie bin with a valid permit
  • Empty garden waste containers that are put out at the designated collection point for the property to where the collection is registered. This includes residents choosing to share the cost of hiring a green wheelie bin
  • Collect garden waste from the same collection point used for black/bin bag waste service
  • Stop collecting garden waste where customers have not paid the annual renewal fee when it is due. No special return journeys will be made to collect garden waste for customers making late payments – customers will have to wait until the next scheduled collection date
  • Collect real Christmas trees (the stump being no larger than 50mm in diameter) put out by registered customers when put out with their green wheelie bin on their scheduled collection day
  • Not empty green wheelie bins that have been contaminated by unacceptable items such as food waste
  • Not provide refunds to customers who cancel their garden waste collection services part way through a year
  • Aim to deliver green wheelie bins within 10 working days from the date service requests are received (post service roll-out)
  • Ensure that pre-used green wheelie bins have been refurbished to a suitable standard before being supplied to a customer
  • Exchange damaged green wheelie bins free of charge if it is the council’s fault. Any other damage will mean a replacement charge of £25 for the customer
  • Reserve the right to remove, without prior notice, green wheelie bins that are reported as left out on a public highway on non-collection days. There will be a fee for re-delivery
  • Provide an assisted garden waste collection to customers that are already registered for this service if they have paid for the chargeable garden waste service
  • Return within five working days for any valid missed collections that the customer has reported
  • Reserve the right to change the collection schedule for operational reasons. We will give customers adequate advance notice of any changes
  • Not empty containers that weigh in excess of 100kg
  • Collect every two weeks from the beginning of February until the end of October and every four weeks from November until end of January, except in periods of severe weather

Responsibilities of the customer

  • Ensure that a valid permit is displayed on the green wheelie bin
  • Store your green wheelie bin within the boundary of your property between garden waste collections
  • Place the correct items in your green wheelie bin
  • If applicable, present your garden waste at the designated collection point for the registered property
  • Put your garden waste out for collection no sooner than 6pm on the day before collection and no later than 7am on the day of collection
  • Return your green wheelie bin to your property after collection for storage until the next collection day
  • Inform the council if you move within North Devon and want to take your green wheelie bin with you, or you no longer require the service

Payment terms

  • Customers who subscribe to the garden waste service will be charged an annual fee for each green wheelie bin. The cost of the service will be reviewed and set each year
  • The annual payment covers from 1 June – 31 May, no matter what point of the year you sign up
  • Six weeks ahead of the end of your subscription period we will send you a renewal notice. Your collections will be stopped from the start of the new year of service charges if payment is not made
  • The cost of the service is non-refundable
  • Customers can pay either online, over the phone, by cheque, or in person at the council offices
  • Customers can subscribe to an unlimited number of green wheelie bins. The charge will be based on multiples of £36 each
  • All green wheelie bins remain the property of North Devon Council
  • Regular contamination of the green wheelie bin will result in the service being removed with no refund given
  • Cleanliness of green wheelie bins is the responsibility of the customer. Damage caused to the bin must be reported to the council immediately
  • Collections not made due to severe weather, or disruptions relating to issues outside the council’s control, will not be refunded
